Tribunal Procedure (First-tier Tribunal) (Property Chamber) Rules 2013
The procedure rules for leasehold cases at the First-tier Tribunal in England: applications, directions, evidence, hearings and costs.
What they do
The Rules govern how the First-tier Tribunal (Property Chamber) runs leasehold cases in England, including service charge disputes, section 20 dispensation, right to manage disputes, lease variations and enfranchisement price disputes.
Key points
- Overriding objective (rule 3): deal with cases fairly and justly, proportionately and without unnecessary formality.
- Directions: the tribunal sets a timetable for statements of case, documents and witness evidence.
- Paper or hearing: many cases, including most dispensation applications, are decided on the papers.
- Costs (rule 13): each side usually bears its own costs; the tribunal can order costs only for unreasonable behaviour or wasted costs. Fees can be reimbursed.
Status
In force. Wales uses the Residential Property Tribunal Wales.
