RTM Companies (Model Articles) (England) Regulations 2009
The prescribed articles of association every right to manage company in England must use.
What it does
An RTM company must be a private company limited by guarantee with the articles prescribed here. Wales has its own version.
What the model articles cover
- Who can be a member: qualifying tenants, and the landlord once the company has acquired the right to manage.
- Voting: votes are allocated per flat, with the landlord getting votes for flats with no qualifying tenant.
- Meetings, notice and quorum.
- Appointment and removal of directors.
- Keeping records and accounts.
Why it matters
When you set up or run an RTM company, the articles cannot simply be rewritten. Freeholdpilot’s voting module reads the model articles’ rules for RTM companies so votes count the right way.
Status
In force in England.
