Service Charges and Administration Charges (Summary of Rights and Obligations) Regulations 2007
The exact wording that must go with every service charge demand and every administration charge demand in England.
What it does
Two sets of regulations made in 2007 prescribe the summary of rights and obligations that must accompany demands in England:
- SI 2007/1257: service charge demands (section 21B of the Landlord and Tenant Act 1985).
- SI 2007/1258: administration charge demands (Schedule 11 to the Commonhold and Leasehold Reform Act 2002).
Wales has its own equivalent regulations with bilingual wording.
Why it matters
A leaseholder may withhold a service or administration charge if the demand did not come with the right summary, and late payment terms in the lease do not apply while it is withheld. The summary must be in at least 10-point type and carry the prescribed heading.
Status
In force. The Leasehold and Freehold Reform Act 2024 will introduce a standard demand form once its regulations are made.
